§ 1. Definitions

The terms used in these Terms of Service shall mean:

1. Terms: This document.
2. Service: The "LoveMatch Online" website, available at lovematchonline.com, operated by the Administrator.
3. Administrator: Global Web Systems Sp. z o.o. with its registered office in Warszawa at al. Jana Pawła II 27, 00-867 Warszawa, Poland, Tax ID (NIP): 7822916705, REGON: 523753217, entered into the Register of Entrepreneurs of the National Court Register under KRS number: 0001004406.
4. User: Exclusively a natural person who is at least 18 years old and has full legal capacity (regardless of gender identity), who has completed Registration after accepting the Terms and the Content Warning.
5. Account: A collection of resources and settings within the Service, assigned to a User.
6. Profile: The User's page within the Account, containing information and Content voluntarily provided by the User.
7. Content: Any materials (including photos, videos, text, messages, graphics) published, uploaded, or shared by the User on the Service.
8. Adult Content: Content of an erotic nature, including depictions of nudity or simulated sexual acts, the publication of which is permitted on the Service under the conditions described in § 3.
9. Services: All services provided electronically by the Administrator, including Paid Services.
10. Paid Services: Paid functionalities of the Service, such as Premium Membership (subscription), virtual currency (Credits), Virtual Gifts, or Profile promotion.
11. Third-Party Providers: Other companies providing services integrated with the Service (e.g., Google, Mapbox, payment operators).
12. Privacy Policy / Cookie Policy: Separate documents, which are an integral part of the Terms, defining the rules for processing personal data and the use of cookies.

§ 2. General Provisions and Conditions of Participation

1. SERVICE FOR ADULTS ONLY. The Service is intended exclusively for adults who are at least 18 years old.
2. Every person entering the Service must pass through an "Age Gate" and confirm they are of legal age. Entering the Service and Registering is equivalent to making a legally binding declaration of being at least 18 years old.
3. The Administrator reserves the right to verify the User's age at any time (e.g., by requesting an ID document or SMS verification) and to immediately delete the Account of a minor.
4. Use of the Service constitutes full acceptance of these Terms, the Privacy Policy, the Cookie Policy, and the Community Guidelines. A User who does not accept these documents must leave the Service immediately.

§ 3. Adult Content Policy (18+)

1. USER'S INFORMED CONSENT: By accepting the Terms and passing the Age Gate, the User declares that they are fully aware and accept that the Service is an adult dating service and that they will be exposed to Adult Content (including photos and videos depicting nudity or erotica) published by other Users.
2. The User declares that they are entering the Service of their own free will, and that exposure to such Content is not offensive, shocking, or otherwise in violation of their feelings or moral norms.
3. RULES FOR CONTENT PUBLICATION BY USER: A User may publish Adult Content (e.g., artistic nudity, erotic photos) provided that:
   • They depict only the User themselves or other consenting adults (over 18 years old).
   • All persons visible in the Content have given informed and voluntary consent to have their image captured and published on the Service.
   • The Content is consensual (with the consent of all parties).
   • The Content is their own property or they possess all necessary rights and licenses.
4. STRICT PROHIBITION OF ILLEGAL CONTENT: The Service has a zero-tolerance policy against publishing, uploading, or promoting Content that is illegal, including but not limited to:
   • Content of a pedophilic nature or in any way depicting minors (under 18 years old).
   • Content depicting violence (including rape), zoophilia, necrophilia, or mutilation.
   • Non-consensual content (e.g., "revenge porn", candid photos, content violating privacy).
   • Content promoting hatred, racism, discrimination, or terrorism.
5. Violation of § 3(4) will result in immediate and permanent deletion of the Account and reporting the matter to law enforcement along with the User's data (including IP address).

§ 4. Registration and User Account

1. Registration is voluntary and free. It requires providing an active email address or using a social media login (e.g., Google).
2. The User is solely responsible for maintaining the confidentiality of their password.
3. The Service may offer additional Account Verification (e.g., via SMS) to increase Profile credibility.
4. The User agrees not to share their Account with third parties, especially minors.

§ 5. Paid Services (Membership, Credits, Payments)

1. Basic functionalities of the Service are free. Access to advanced features (e.g., unlimited messages, profile visitors, Virtual Gifts) may require the purchase of Paid Services.
2. The Service offers Paid Services in the following models:
   • Premium Membership (Subscription): A paid plan (e.g., monthly, annual) that may renew automatically. The User agrees to automatic charges unless they cancel the subscription in their Account panel before the end of the current billing period.
   • Credits (Virtual Currency): One-time purchases of virtual credit packs, which can be exchanged for specific actions on the Service (e.g., sending a Virtual Gift).
3. VARIABILITY OF SERVICES AND PAYMENT METHODS: The User acknowledges and accepts that:
   • The availability of specific Paid Services, their prices, and currencies may differ based on the country (jurisdiction) from which the User accesses the Service.
   • Available payment methods (e.g., credit card, online transfer, e-wallet) depend on the User's region and are processed by various Third-Party Providers (Payment Operators), such as Stripe, PayPal, PayU, or others.
4. Credits and Virtual Gifts have no monetary value outside the Service, are non-refundable, and cannot be exchanged for cash, unless otherwise required by law. Unused Credits may expire after 12 months from the date of purchase.
5. Right to Withdraw from the Contract (EU Consumers): A User who is a consumer has the right to withdraw from a Paid Service contract within 14 days of its conclusion. However, by purchasing a Paid Service (e.g., a credit pack or activating Membership), the User gives explicit consent to the performance of the Service beginning before the 14-day withdrawal period expires. The moment the service is fully performed (e.g., Credits are granted or Membership is activated), the User loses their right to withdraw.

§ 6. Rules of Conduct (Community Rules)

1. The User agrees to comply with the law, good conduct, and these Terms. Detailed "do's and don'ts" are set forth in the "Community Guidelines" document.
2. It is strictly forbidden to:
   • Publish Content that violates § 3 (Prohibition of Illegal Content).
   • Engage in commercial activities, "spamming," solicitation, or offering commercial services (including prostitution or any form of sponsorship).
   • Harass, insult, intimidate, or "stalk" other Users.
   • Impersonate other people (including creating "fake profiles") or the Administrator.
   • Post contact information (phone numbers, addresses) in public areas of the Profile (e.g., on photos).

§ 7. Role and Responsibility of the Administrator (Disclaimers)

1. HOST STATUS: The Administrator is merely a provider of the platform (host) for User Content. The Administrator is not liable for Content published by Users, provided that the Administrator had no actual knowledge of its illegal or infringing nature and acted expeditiously upon receiving a valid notice.
2. NO BACKGROUND CHECKS: The Administrator DOES NOT conduct criminal background checks on its Users nor does it guarantee the truthfulness of the data provided on Profiles (even if a Profile is "Verified" by SMS or photo).
3. USER'S RISK: The User engages in interactions (both online and offline) at their own sole risk and responsibility. The Administrator is not liable for the conduct of Users or for any damages (mental, physical, financial) resulting from interactions with other Users.
4. The Administrator strongly recommends reading the "Safety Tips" document available on the Service.
5. The Service is provided on an "as-is" basis. The Administrator does not guarantee uninterrupted, error-free availability of the Service and reserves the right to schedule maintenance breaks.

§ 8. Third-Party Services and Providers (Google, Mapbox, etc.)

1. The Service is integrated with services provided by Third-Party Providers. By using the Service, the User may also be using the services of these companies.
2. We use, in particular:
   • Google (Analytics, AdSense, Maps, Captcha): For traffic analysis, advertising, map displays, and anti-spam security.
   • Mapbox: For alternative map and geolocation services.
   • Atom Chat: To operate the live chat functionality.
   • Twilio: For phone number verification.
3. The User acknowledges that:
   • Use of these features may require acceptance of the providers' separate terms of service.
   • These providers process User data (e.g., IP, geolocation, ad identifiers) according to their own privacy policies.
   • Use of these services may involve the transfer of personal data outside the European Economic Area (e.g., to the USA), as further detailed in the Privacy Policy.

§ 9. Moderation, Blocking, and Account Deletion

1. The Administrator reserves the right to moderate, edit, or remove Content that violates the Terms, without prior notice.
2. In the event of a serious or persistent violation of the Terms (especially § 3(4) and § 6), the Administrator has the right to temporarily or permanently block (ban) or delete the Account.

§ 10. User Responsibility and Indemnity

1. Content Responsibility: The User (he/she/they) bears full and sole legal and civil responsibility for all content published within the Service, including profile information, private messages, and blog comments. Such content expresses only the opinions of the author and does not reflect the views of the Administrator.
2. Prohibited Content: It is strictly forbidden to post content that is vulgar, offensive, promotes hatred, constitutes spam, advertising, violates the law, or breaches our Community Guidelines.
3. Indemnification: The User agrees to indemnify, defend, and hold harmless the Administrator from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) resulting from the User’s violation of these Terms or the infringement of any third-party rights. This indemnity applies regardless of the negligence of any party.

§ 11. Moderation and Reporting

1. Right to Report: Users have the right and obligation to report any content or behavior that violates these Terms or the law. Reports should be made via the "Report" mechanism within the app or by contacting support@lovematchonline.com.
2. Right to Deletion: A User has the right to request the deletion of their own content or account. Requests should be sent to the support email with sufficient details to verify ownership.
3. Administrator’s Rights: The Administrator reserves the right to moderate, edit, or remove any content (including profiles and messages) that violates these rules, without prior notice to the author.

§ 13. Final Provisions

1. Changes to Terms: The Administrator reserves the right to change these Terms for important reasons. Users will be notified of significant changes at least 14 days in advance via the Service or email.
2. Governing Law: These Terms shall be governed by and construed in accordance with the laws of Poland.
3. Dispute Resolution and Class Action Waiver: All disputes shall be settled by the court competent for the Administrator's registered office. To the maximum extent permitted by law, all proceedings to resolve any dispute will be conducted solely on an individual basis and not in a class, consolidated, or representative action.
4. Language Precedence: These Terms are provided in multiple languages for the User's convenience. In the event of any conflict, discrepancy, or inconsistency between the English version and any translated version, the English version shall prevail and be the binding version for all legal purposes.
5. Entire Agreement: These Terms constitute the entire agreement between the User and the Administrator regarding the use of the Service, superseding any prior agreements or communications. If any provision is found to be invalid, the remaining provisions shall remain in full force and effect.
6. Effective Date: These Terms come into effect on December 18, 2025.
